Terms of use

Effective

These terms are an agreement between you and [Operator name] (“Byte Balance”, “we”, “us”) for your use of the Byte Balance app and bytebalance.co.in (the “Service”). By creating an account or using the Service you agree to them. Our privacy policy explains how we handle your data.

1. Not medical advice

Byte Balance provides general nutrition and fitness information to help you track what you eat. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Calorie, nutrient and portion figures — especially those estimated by AI from photos, voice or text — are estimates and may be inaccurate. Do not rely on the Service for medical decisions. Talk to a doctor or registered dietitian before changing your diet if you are pregnant or breastfeeding, have diabetes, kidney disease, an eating disorder or any other medical condition, or take medication. If you think you have a medical emergency, contact your local emergency services.

2. Who can use Byte Balance

You must be at least 18 years old and able to form a binding contract. You are responsible for your account, for keeping your password secure, and for everything that happens under it. Tell us at once at [email protected] if you think your account has been compromised.

3. Subscriptions and payment

4. Your content

You own the content you add, such as photos, logs and messages. You give us a limited licence to store, process and display it only as needed to provide the Service to you (and to household members you share with). We do not use your content for advertising.

5. Acceptable use

You agree not to:

We may suspend or close accounts that break these terms.

6. AI features

AI features generate estimates and suggestions automatically. They can be wrong, incomplete or not suited to you. Review AI output before relying on it. Usage limits may apply to AI features to keep the Service available for everyone.

7. Changes to the Service and these terms

We improve the Service continually and may add, change or remove features. If we make a material change to these terms, we will tell you in the app or by email before it takes effect. If you keep using the Service after that, the new terms apply; if you don’t agree, stop using the Service and delete your account.

8. Ending your use

You can stop using Byte Balance at any time and ask us to delete your account by emailing [email protected]. Cancelling a subscription is done separately in your Apple ID settings.

9. Disclaimers and liability

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, and we are not liable for indirect, incidental or consequential loss, or for any loss arising from reliance on nutrition estimates. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the law of the country where you live.

10. Apple

These terms are between you and us, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support, and is a third-party beneficiary of these terms with the right to enforce them against you. Your use of the app must also comply with the Apple Media Services Terms.

11. Governing law

These terms are governed by the laws of India. Disputes will be heard by the courts of [City], India, unless the law of the country where you live gives you the right to bring proceedings there.
